Legalization on Gay Marriage

Passing a bill is a long and complex situation, but when the topic of the bill is controversial it creates a national debate. For example, the legalization of gay marriage is such a disputable issue that it is difficult to see how the government gets anything done in the process. So far, seventeen states have legalized marriage. (six were decided by Court Decision, eight were decided by State Legislature and three were decided by popular vote) As Barack Obama stated, “I believe marriage is between a man and a woman. I am not in favor of gay marriage. But when you start playing around with constitutions, just to prohibit somebody who cares about another person, it just seems to me that’s not what America’s about. Usually, our constitutions expand liberties, they don’t contract them.”


As we have come to know, the legislative process of a bill passing is very intricate, how can such an issue like gay marriage get passed? Recently, U.S. district courts in Utah, Oklahoma, Virginia, Texas, and Michigan have declared state constitutional amendments banning same-sex marriage to be unconstitutional under the Constitution of the United States. All of the rulings have been stayed from enforcement pending appeals.  On the other hand, many jurisdictions have legalized same-sex civil marriage through court rulings, legislative action, and popular vote, four states prohibit same-sex civil marriage by statute and 29 prohibit it in their constitutions. Social media has had an immense influence on the legalization. In fact, Some have argued that the successful use of social media websites by LGBT groups has played a key role in the defeat of religion-based opposition.

Obviously gay marriage is not easy to discuss due to all the different interpretations taken from the Bible, Constitution and the amendments. The 1st amendment of the Constitution states that a person’s religious beliefs or a lack of thereof must be protected. Legislatures also cannot discriminate against marriages of the minority party which, homosexual people fall into that category. There is also an amendment stating there is separation of church and state, so you cannot declare that a marriage is a gift from God. Everyone interoperates pieces of art, political cartoons and laws differently so it is important to acknowledge others thoughts and opinions but also stand firm in what you believe in.

Even though the Bible states marriage should be between a man and a woman, as Christians we are supposed to look and love everyone with equality. This goes into the issue, as stated previously, about interpretation. I know I am naive on the complexity behind the topic but everyone sins different and I am sure they have their own convictions but we should not be able to decide if two other people, who have no relation to us, should get married or not. it is necessary to set aside religious issues to look at this debate from a legal standpoint.  It is necessary that the government recognize the civil unions of same sex couples because all citizens of the United States should be afforded equal rights regardless of race, gender or sexual orientation.  It is because of this legal discrimination that homosexuals are denied rights. Discrimination is wrong.  The first step in correcting social injustice must be taken soon.  The issue of legal marriage between two people of the same- sex must be settled now to stop the discrimination that is openly occurring across America, even when the legalization process seems near to impossible at times.
